📄 General Terms and Conditions (GTC) for the Stay at “Happy Place” This English translation is provided for convenience only. In case of discrepancies, the German version shall prevail. 1. Conclusion of Contract By booking (in writing, by phone, online or via booking platforms), a binding rental agreement is concluded between the guest (tenant) and me, Jasmin Höcherl, as the host. By making the booking, the guest accepts these terms and conditions. The booking confirmation serves as proof of the contract. 2. Prices and Payment Terms Full payment of the accommodation price and any additional services (e.g. cleaning fee €180 per stay, unless otherwise stated) is due at the latest upon check-in, unless otherwise agreed. For direct bookings, a deposit of 20% is due within 7 days after booking; the remaining balance is due 7 days before arrival. Accepted payment method for direct bookings: bank transfer. Note: For platform bookings, the respective payment processes of the portal apply. 3. Cancellation Policy Cancellations are possible at any time; the date of receipt of the written cancellation notice applies. The following cancellation fees apply (percentage of the total rental amount): – up to 13 days before arrival: 20% – up to 7 days before arrival: 50% – from 6 days before arrival or in case of no-show: 100% The guest has the right to prove that no or significantly lower damage has occurred. If the apartment is re-let, the new rental income will be offset. I recommend taking out travel cancellation insurance. 4. Right of Withdrawal There is no right of withdrawal for accommodation services (§ 312g para. 2 no. 9 BGB). 5. Arrival and Departure The apartment is available from 4:00 PM on the day of arrival. On the day of departure, the apartment must be vacated by 10:00 AM. Late check-out only possible by prior agreement. 6. Use of the Apartment The apartment may only be used by the booked number of guests. Visitors or additional overnight guests only upon prior agreement. Pets are not allowed. Parties, loud gatherings and commercial use are prohibited. The house rules are an integral part of these GTC. Surcharges for additional guests apply according to the booking details or platform. 7. Liability I am liable without limitation for intent and gross negligence as well as for injury to life, body or health. For simple negligence, I am only liable for breaches of essential contractual obligations (cardinal duties); in such cases, liability is limited to the foreseeable, typical contractual damage at the time of conclusion. I am not liable for valuables brought by the tenant, except as provided by law. Force majeure (e.g. official orders, power outages, pandemics) does not create liability beyond statutory provisions. 8. Cleaning and Condition The apartment must be left broom-clean. Waste must be properly separated; dishes should be washed or the dishwasher started. Excessive dirt or damage may result in additional charges. 9. Registration Requirement The guest is obliged to provide all necessary information for registration (e.g. name, address, date of birth, nationality) completely and truthfully. 10. Data Protection Personal data will be used exclusively for processing the booking and will not be passed on to third parties, except where required by law (e.g. registration regulations). For details, please see the Privacy Policy on this website. 11. Final Provisions German law applies. If the tenant is a merchant, legal entity under public law, or acting in a commercial capacity, the exclusive place of jurisdiction is [location of the accommodation]. For consumers, the statutory places of jurisdiction apply. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
